Terms and Conditions

These Terms and Conditions (“Terms”) apply to the ‘Commission Matching Program’ (“Promotion”), sponsored by OspreyFX (“Sponsor”, “Osprey”). By participating in the Promotion, the Participant (“you”,”your”) understand the Terms and agree to be bound by these Terms and to the decisions of the Sponsor, which are final and binding in all matters relating to the Promotion. The Promotion is available to any individual who is eighteen (18) years and above.

1. General Introduction

1.1 The Terms stipulated herein must be read in conjunction with the General Terms and Conditions found on the Osprey website (“Osprey T&C’s”). All Affiliates who register with Osprey from October 1st 2023 till December 1st 2023 are in the chance to join a commission matching program.

2. Promotion Details

2.1 This Promotion runs from October 1st at 00:00 and will finish on December 1st, 2023, at 23:59, and is available to all new Osprey Affiliates that are eighteen (18) years or older. Osprey reserves the right to verify the eligibility of entries and may require additional information from participants.

3. Signing up/Logging in

3.1 The Promotion is open to existing and new Osprey traders who sign up for the Affiliate Program found on the Osprey website. Traders with existing Osprey Accounts can enter the giveaway by logging into their account and joining the Affiliate Program, becoming an affiliate (“Affiliate”). New traders must register with Osprey to become a trader and then join the Affiliate Program. Upon joining the Affiliate Program, participants will receive an affiliate link, which is a unique code which must be shared with ten (10) or more individuals/followers. This code includes a URL to the Sign-Up portal for your followers to access.

4. Disqualification

4.1 Affiliates found to be in breach of any Osprey T&C’s will not be eligible for any agreement. This includes but is not limited to any fraudulent activity that may be detected, which could jeopardize fairness or equality between Affiliates.

5. Modification or Termination

5.1 Osprey reserves the right to modify, suspend, or terminate the Promotion at any time without incurring liability.

5.2 If an Affiliate is found to be promoting their affiliate link in a manner that is unethical, illegal, or otherwise in violation of these Terms, Osprey reserves the right to terminate the Affiliate’s participation in the Affiliate Program and/or the Promotion, and may disqualify them from the agreement.

6. Acceptance of Terms

6.1 By taking part in this Promotion, and accepting the Terms; you are also accepting Osprey’s T&C’s.

6.2 Once signing up as an Affiliate, the terms of affiliation, including but not limited to commission structure, payment schedule, promotional materials, and other relevant matters, are subject to discussion and mutual agreement between the Affiliate and the Osprey designated affiliate manager (“Affiliate Manager”).

6.3 The Affiliate acknowledges that the Affiliate Manager will work with the Affiliate to establish the terms of the affiliation in accordance with the Program’s guidelines and the Osprey policies regarding Affiliates, which can be found on our website.

7. Data Protection and Privacy Policy

7.1 In addition to the Privacy Policy found under Osprey T&C’s, the following shall also apply in relation to this Promotion:

7.1.1 When conducting this Promotion, Osprey may collect the Participants personal information like name, email and mailing address. Osprey safeguards this data through a secure website and information security measures (e.g., encryption protocols, firewall systems).

7.1.2 Osprey refrains from retaining personal data beyond the Promotion’s purpose or sharing it with third parties, except as necessary for Promotion administration. The giveaway adheres to data privacy laws and official rules explicitly detail data collection, utilization, retention and disposal procedures.

7.1.3 Osprey does not employ entrant information for giveaway/sweepstakes mailing lists without consent or a clear opt-out method. Consent for future emails includes prominent opt-out options. In the same vein, Osprey maintains a notification system enabling individuals to exclude their details from mailing lists used for skill contests or giveaways.

8. Limitation of Liability

8.1 Osprey is not responsible for:

8.1.1 any technical issues that may prevent participation in the Promotion. This includes but is not limited to any malfunctioning affiliate links.

8.1.2 any losses or damages of any kind that may be sustained as a result of the Promotion. Therefore, the Participant and/or winner shall hold harmless Osprey from and against all claims, demands, costs and expenses (including legal costs and expenses) or liabilities of whatever nature or kind arising out of or in connection with the Promotion;

8.1.3 any delays or interruptions of service or transmissions, or failures of performance of Osprey’s or its affiliate systems, regardless of cause, including, but not limited to, those caused by hardware or software malfunction; regulatory action; acts of God; war, terrorism, or our intentional acts.

8.1.4 the manner in which the Affiliate promotes the affiliate link. Osprey does not endorse, condone, or assume responsibility for any actions, content or methods used by Affiliates in promoting their links.
