The following Terms and Conditions (“T&Cs”) will govern over the following OspreyFX Giveaway (“Giveaway”) and shall prevail in the event of any conflict, discrepancy or otherwise inconsistency with any other communications including, without limitation, eventual advertising, or promotional materials.

This Giveaway is being organized by and under the responsibility of Osprey Ltd (hereinafter referred to “OSPREYFX”, “We”, “Our”).

The following T&Cs are to be read carefully and in their entirety before participating in the Giveaway. You (“You”, “Your” or “Participant”) will be under no obligation to participate in the Giveaway and if You have any reservations or difficulty in fully understanding, or otherwise disagree with these T&Cs, whether completely or in part, You should not participate in the Giveaway.

Furthermore, by participating in the following Giveaway You would be accepting Our General Terms and Conditions (“GTCs”)

1. TERM

• The current Giveaway will be launched on Monday the 12th of February 2024 at 0:00 ( server time ) till Sunday the 18^th of February 23:59 2024 ( server time ).
• In order to Participate in the Giveaway, You will need to register before the 12th of February.
• This form of Giveaway will be held weekly.
• The next giveaway will be launched on the following Monday and will end on the following Sunday.
• Any person who fails to participate within the aforementioned time period will not be eligible to partake in the Giveaway.

2. HOW TO PARTICIPATE AND ELIGIBILITY

• The same rules in the GTCs will apply to You in order to be considered as an eligible Participant;
• To be considered as a Participant, You need to have accessed OspreyFX Website (“Website”) and, registered on the Platform (“Platform”) as a User (“Registered User”). Once registered You are to open a Live TradeLocker Competition Trading Account (“ OspreyFX TradeLocker Weekly Competition Account”) for the Giveaway;

3. RULES OF THE GIVEAWAY

• A minimum of 1 standard lot must be traded throughout the Giveaway period. The lots can be traded on any given day throughout the Giveaway;
• Participant must trade for a minimum of 3 days throughout the Giveaway period. The trade does not have to happen in a consecutive manner;
• As a Participant, if You no longer wish to partake in the Giveaway, You can withdraw the deposit from the Live Trading Account. However, once You do so You will no longer be considered in the possibility of winning the following Prizes (“Prizes”);
• Moreover, during the Competition, You can withdraw any funds from the Competition account, in order to still be an eligible Participant in the competition You need to follow these necessary criteria;
• The Participant needs to close all the Trades once the market has closed at the end of the Competition period.

4. DISQUALIFICATION FROM THE GIVEAWAY

• If the Participant does not close all the Trades once the market has closed at the end of the Giveaway, they will automatically not be eligible to the following Prizes;
• Disqualification will also result if the minimum trading criteria have not been met.

5. DISQUALIFICATION AND DEPOSITS MADE BY THE PARTICIAPANT

• When the participant is disqualified due to any of the above circumstances, the funds deposited will not be lost. You can withdraw the remaining balance, or You can keep trading with the balance available in the Live Trading Account;
• Once disqualified the Live Trading Account will not be closed by OspreyFX;

6. CLOSURE OF THE GIVEAWAY

• Once the Competition has been closed, You can still keep using the Live Trading Account to trade and make any necessary withdrawals in accordance with the GTCs;
• Upon closure OspreyFX team will analyze the list with all the Account IDs of the Participants who are eligible to win the following Prize.

7. WINNER AND PRIZES

• The Winner (“Winners”) will be the users with the highest profit generated
• The Winners will be contacted by OspreyFX team on their Registered User email to certify that Participant is the Winner of the Competition, and  further instructions on the delivery of the respective prizes;
• Osprey FX will explain the Winner that their details will be shared on their Instagram Account (“OspreyFX Instagram Account”), showing that they have won the Competition. Moreover, OspreyFX will request the Winner to collaborate with them in producing a 1-minute video to confirm such a win. However, the video will only be created and uploaded on social media once the Winner has given their full consent;
• Subject to these T&Cs the Winners will be awarded an iPhone 15, $50k and $25k funded account as shown on the landing page;
• The appointment of the winner pursuant to the foregoing shall be final, and no correspondence will be accepted or otherwise entered into;
• The Prize is non-negotiable and non-refundable. cash alternative will be offered in place of 1st prize only. Where a Prize becomes unavailable for any reason, we reserve the right to retract it or substitute it for a Prize of equal or higher value, at Our sole discretion.
• Under no circumstance shall OspreyFX be deemed responsible for or liable for any eventual setbacks, delays or otherwise errors in connection with the delivery of the Prize.
• Without prejudice to the foregoing, once the Prize has been either delivered to or collected by the winner, as the case may be, OspreyFX may not be deemed responsible or liable therefrom for any errors, loss of or damages to the Prize, whether in whole or in part, arising from or otherwise in connection with the handling of the delivery method, whether in error or negligence.

8. PROTECTION OF PERSONAL DATA

• All Personal Data of the Participant is protected by OspreyFX, in accordance General Data Protection Regulation (EU) 2016/679 (“GDPR”) and applicable national laws and regulations.
• OspreyFX may take all the necessary measures to protect the personal data of the participants including, without limitation, seeking and obtaining appropriate consents, implementing appropriate technical and organizational measures, and ensuring that all data processing activities are lawful, fair, and transparent.

9. DISCLAIMER

• We reserve the right, and in Our sole discretion, to cancel, terminate, suspend and/or modify the Giveaway, or any part of it, at any time, without notice, and to cancel, terminate, modify or suspend the Giveaway in whole or in part, at any time, without notice and award a Prize using all non-suspect eligible entries received as of the termination/suspension date, due to unforeseen and uncontrollable circumstances beyond Our control.
• Without prejudice to the foregoing, to the extent permitted by applicable law, OspreyFx’s liability under or in connection with the Giveaway or these terms and conditions shall be limited to the cost price of the Prize in question.
